AI Supplementary Terms

EFFECTIVE DATE: November 1, 2024

These Deep Sentinel Corp. (“Deep Sentinel”) AI Product Terms (“AI Terms”) form a part of the Deep Sentinel Corp. Privacy Policy, Terms of Service, and any master services agreement, as applicable, between you and Deep Sentinel (the “Agreement”). These AI Terms apply to your access and use of any AI Feature(s) and are incorporated by reference into the Terms of Service.  By using the AI Features, you hereby accept and agree to be bound by these AI Terms.  Any terms used but not defined herein have the same meaning as in the Agreement.

  • Definitions

“AI Features” means features, functionality and capabilities offered as part of the Services or integrated therein that utilize artificial intelligence, machine learning or similar technologies developed by Deep Sentinel and/or Deep Sentinel’s third-party providers (the “AI Providers”).

“Input” means user generated content that you provide for use with the AI Features, including Video Content.

“Training Data” means any data, text, materials, images, and other content used to train, validate, customize, test, or improve an AI model (including the AI Features).

“Output” means any response generated by the AI Features in response to the Input that is provided directly to you.

  • Intellectual Property.  Deep Sentinel and the AI Providers, as applicable, exclusively own all right, title, and interest in and to the AI Features, including all associated intellectual property rights, and except for the rights to use provided in the Agreement, no other rights or permissions to any of the AI Features is granted.
  • Inputs and Outputs.  You may provide Input to be processed by the AI Features and generate Output in connection with your use of the AI Features. You are solely responsible for the development, content, operation, maintenance, and use of your Input. In addition to the provisions of the Privacy Policy and Terms of Service, you will ensure that your Input will not (i) violate any applicable law; (ii) violate these AI Terms or the Agreement; or (iii) infringe, violate, or misappropriate any of our rights or the rights of any third party. You acknowledge that due to the nature of machine learning and the technology powering AI Features, Output may not be unique, consistent, or accurate and the AI Features may generate false Output to Deep Sentinel and you acknowledge that you have no right, title, or interest in or to any Output.
  • Providing the AI Features.
    • Notwithstanding anything to the contrary in any applicable agreement between you and Deep Sentinel, Deep Sentinel may collect and use data of your interaction with, or use of the AI Features, including Input and/or Output in order to: (i) provide you with the AI Features’ functionalities; (ii) maintain, improve, modify, and develop the AI Features; (iii) comply with applicable laws and regulations; and (iv) enforce the respective policies applicable thereto.
    • Use Restrictions. You may not use the AI Features (i) to mislead any person that Output from the Services was solely human generated; or (ii) in a manner that violates the Agreement or any technical documentation and usage guidelines.
  • AI Features.  You consent to Deep Sentinel’s use of Inputs as Training Data and acknowledge and agree that you have no right, title, or interest in any Output. Deep Sentinel and its licensors adhere to applicable legal requirements and industry standard policies, procedures and/or voluntary commitments relating to the ethical or responsible use of AI, including as pertaining to: (a) adhering to the protocols set forth in Artificial Intelligence Risk Management Framework (AI RMF 1.0, as revised from time to time) promulgated by the National Institute of Standards and Technology (“NIST”) for designing, developing, and deploying AI, (b) designing, developing, testing and deploying AI in a manner that promotes transparency, responsibility, fairness, accountability, and human interpretability, and (c) identifying and mitigating bias in Inputs used for training purposes and/or harmful behavior in the AI Features, including without limitation bias and harmful behavior relating to race, gender, ideology or other legally protected classes.
  • Accuracy. Deep Sentinel does not make any representation, warranty or indemnity as to the results that may be obtained from the use of the AI Features, the Outputs or the accuracy, currency or completeness of any other information obtained through the AI Features. You acknowledge and agree that the Services will not function if the AI Features cannot run as intended, for any reason. Any information provided by Deep Sentinel or its AI Features does not replace emergency services and should not be relied upon as a security or safety system. You understand and agree that any material and/or data obtained through the use of any AI Features is done at your sole risk. You should not rely on factual assertions in Output without independently fact checking their accuracy. Output that appears accurate because of the detail of specificity may still contain material inaccuracies. The AI Features cannot dynamically retrieve information, and Output may not account for events or changes to underlying facts occurring after the applicable model was trained. No information or response, whether oral, auditory, or written, obtained by you from Deep Sentinel or through the AI Features shall create any warranty not expressly made herein.
  • Usage Limits. Deep Sentinel may monitor and limit or suspend your usage of the Services as set forth in the Terms of Service by suspending your Service or initiating Privacy Mode if Deep Sentinel believes your usage may bypass or circumvent any rate limits, negatively affect the security, operability, or integrity of any Services, violate the Agreement or otherwise impose liability on Deep Sentinel.
  • Miscellaneous.  At its sole discretion, Deep Sentinel may modify or replace any of the AI Terms or change, suspend, or discontinue the AI Features (including without limitation, the availability of any feature) at any time by posting a notice on the Deep Sentinel websites or Service or by sending you an email. It is your responsibility to check the AI Terms periodically for changes. Your continued use of the AI Features following the posting of any changes to the AI Terms constitutes acceptance of those changes. You acknowledge that continued access and use of the AI Features, or certain features therein, may be subject to your agreement to pay additional fees. Use of the AI Features is optional.
